  3. Terms and Conditions.

  5. 1.  The WinNET Mail & News (TM) software, Core TCP/IP
  6.     protocol stack, and WWW browser installation software is
  7.     distributed freely for the purpose of connecting with
  8.     the WinNET service.  There is no charge for the software
  9.     as long as it is used for this purpose. 
  10.  
  11. 2.  The WinNET service is billed on a monthly flat rate
  12.     basis of 
  13.  
  14.                 $19.95 per month.
  15.  
  16.     When you use the U.S. 800 access number you get 
  17.                 
  18.                 four (4) connect hours per month.
  19.     
  20.     Usage beyond the first four hours is billed at the rate
  21.     of 
  22.  
  23.                 $5.40 per hour.
  24.  
  25.     When you use the direct dial number (502) 589-4131 you get
  26.  
  27.                twenty (20) connect hours per month.
  28.  
  29.     Usage beyond the first twenty hours is billed at the rate
  30.     of $1.00 per hour.
  31.  
  32.     Service is billed on a calendar month basis.  The flat
  33.     rate and the corresponding four connect hours are
  34.     prorated in the first and last calendar month of
  35.     service.

  37.     Connect time is recorded in increments of one minute. 
  38.     Fractions of minutes are billed as full minutes.  All
  39.     amounts are denominated in U.S. dollars.

  41. 3.  Canadian toll free 800 number service access is also 
  42.     available.  The WinNET Service charge of $19.95 gives 
  43.     1.5(one and one half) hours of access and a charge of 
  44.     $15.40 per hour thereafter.

  46. 4.  Payment.  As part of your account registration we
  47.     request a credit card number for payment.  You will be
  48.     charged $19.95 when you first establish your account as
  49.     payment of your first month of service.

  52. 5.  You will be sent a statement of account usage via
  53.     WinNET mail after the end of the month.  Your credit 
  54.     card will be charged for the amount on the statement.

  56.     Other payment arrangements are possible, please contact
  57.     us (telephone: 1-800-WIN-NET2 or 502-589-6800).

  59. 6.  Ending Service.  If you choose to terminate your account
  60.     on WinNET, all you need to do is contact us by WinNET
  61.     Mail (accounts@win.net), letter, or telephone.  We will 
  62.     end your service on the date that you request and prorate 
  63.     your charge for that month accordingly.

  65. 8.  WinNET Communications exercises no control whatever over
  66.     the content of the information passing through the
  67.     WinNET system.  WinNET Communications is not responsible
  68.     for the accuracy, quality, or content of the information
  69.     obtained through its service.  WinNET Communications
  70.     makes no warranty, whether expressed or implied, for the
  71.     service it offers.  WinNET Communications disclaims any
  72.     warranty of merchantability of fitness for a particular
  73.     purpose.

  75. 9.  WinNET Communications makes no warranty whether
  76.     expressed or implied for the WinNET software.  No
  77.     warranty of merchantability or fitness for a particular
  78.     purpose is provided for the WinNET software. 
  79.  
  80. 10. WinNET may only be used for lawful purposes.
  81.     Transmission of any material in violation of United
  82.     States law, laws of the nation in which WinNET is used,
  83.     or state law or regulation is prohibited.  This 
  84.     includes, but is not limited to: copyrighted material,
  85.     material legally judged to be threatening or obscene, or
  86.     material protected by trade secret.  You agree to
  87.     indemnify and hold harmless WinNET Communications from
  88.     any claims resulting form your use of the WinNET service
  89.     or WinNET software which damages you or another party.
